ELIGIBILITY: The Promotion is open to people 19 years of age or older (as of date of entry) who are legal residents of Canada and reside in the Province of Ontario. The officers, directors, and employees of EVOLVE and affiliated companies/clinics and all advertising, promotion and judging agencies, persons engaged in the development, production or distribution of materials for this Promotion (collectively the “Promotion Parties”) and immediate family members or persons living in the same household (whether related or not) are not eligible to participate in this Promotion.
AGREEMENT TO RULES: By participating, the Contestant (“You”) agrees to be fully unconditionally bound by these Rules, and You represent and warrant that You meet the eligibility requirements. In addition, You agree to accept the decisions of EVOLVE as final and binding as it relates to the content of this Promotion.
PROMOTION PERIOD: Entries will be accepted online starting MARCH 20, 2023 at 12:01 PM EST and ending MARCH 24, 2023 at 11:59 AM EST (the “Promotion Period”). All online entries must be received by MARCH 24, 2023 at 11:59 AM EST
HOW TO ENTER: Follow all entry requirements on Instagram regarding the giveaway, for a chance to win the prizes noted above. If you haven’t already, you will need to create an Instagram (instagram.com), account (additional terms and conditions apply). This Promotion is not sponsored, endorsed or administered by, or associated with Instagram. You understand that you are providing your information to EVOLVE and not to Instagram. The entry must fulfill all Promotion requirements, as specified, to be eligible to win a prize. Entries that are incomplete or do not adhere to the rules or specifications may be disqualified at the sole discretion of EVOLVE.
SELECTION OF WINNERS: EVOLVE will randomly draw one (1) winner (the “Winner”) from Instagram at the conclusion of the Promotion Period from the eligible entries received during the Promotion Period.
NOTIFICATION AND RELEASE: Potential winner(s) will be notified by EVOLVE or its designated agency via direct message on Instagram and must respond within a 24-hour time period from the date and time stamp the message was sent by EVOLVE or its designated agency. If a reply is not received within the time requested, the prize will be deemed as undeliverable and will result in forfeiture, and EVOLVE will randomly select an alternate Winner. Prizes will be awarded within sixty days after the Winner has been verified. Prizes cannot be shipped to PO Boxes.

ESTIMATED Value of $300. Actual/appraised value may differ at time of prize award. The specifics of the prize shall be solely determined by EVOLVE. No cash or other prize substitution shall be permitted except at EVOLVE’s discretion. The prize is nontransferable. Any and all prize-related expenses, including without limitation any and all federal, provincial, and/or local taxes, shall be the sole responsibility of Winner. No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by Winner is permitted.
BINDING EFFECT: By submitting your entry you agree to be bound by these Official Rules and failure to comply with these Official Rules may result in disqualification. All federal, provincial and local laws apply.
RIGHTS GRANTED BY YOU: By entering this content, You represent and warrant that your entry is an original work of authorship, and does not violate any third party’s proprietary or intellectual property rights. If your entry infringes upon the intellectual property right of another, You will be disqualified at the sole discretion of EVOLVE. If the content of your entry is claimed to constitute infringement of any proprietary or intellectual proprietary rights of any third party, You shall, at your sole expense, defend or settle against such claims. PUBLICITY RELEASE: Except where prohibited by law, acceptance of a prize shall constitute the Winner’s agreement with EVOLVE to use their name, address, voice, likeness and prize information for promotional purposes without further payment or compensation.

TERMS & CONDITIONS: EVOLVE reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Promotion should virus, bug, non-authorized human intervention, fraud, or other cause beyond EVOLVE’s control corrupt or affect the administration, security, fairness, or proper conduct of the Promotion. In such case, EVOLVE may select the Winner from all eligible entries received prior to and/or after (if appropriate) the action taken by EVOLVE. LIMITATION OF LIABILITY: By entering, You agree to release and hold harmless EVOLVE and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) such entrant’s participation in the Promotion and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Promotion; (v) electronic or human error in the administration of the Promotion or the processing of entries.
Disputes: THIS Promotion IS GOVERNED BY THE LAWS OF Ontario, Canada WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Promotion, participant agrees that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Promotion, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Ontario having jurisdiction.
